Privacy Policy (Personal Information Protection Policy)

WAMNET Japan K.K. (the “Company”) hereby declares that, with respect to the personal information of its customers, business partners, and other individuals that the Company handles in the course of its business, the Company will comply with all applicable laws, regulations, and other standards concerning the protection of personal information, while also taking international developments into consideration. The Company has established voluntary rules and an appropriate management framework and hereby sets forth, implements, and maintains the following Privacy Policy (Personal Information Protection Policy).

Article 1. Acquisition and Use of Personal Information

The Company will acquire personal information only to the extent necessary for the operation of its business and by lawful and appropriate means. The Company will specify the purposes of use in advance when an individual provides personal information and, except as otherwise permitted by applicable laws and regulations, will use such information only within the scope of the specified purposes. The Company will also take appropriate measures to prevent personal information from being used for purposes other than those specified.

Article 2. Compliance with Laws and Regulations and Continuous Improvement

The Company will comply with all applicable laws and regulations, guidelines established by the Japanese government, and other standards concerning the handling of personal information. The Company will establish a personal information protection management system, review it as appropriate, and continuously improve it. The Company will also provide education and training to its officers, employees, and all other persons engaged in the Company’s business in order to ensure the proper protection of personal information.

Article 3. Security Control Measures

The Company will endeavor to implement appropriate and reasonable preventive, corrective, and precautionary measures, from both technical and organizational perspectives, against risks including unauthorized access to personal information and the leakage, loss, or damage of personal information.

Article 4. Provision to Third Parties and Management of Contractors

Except where the consent of the individual has been obtained or where otherwise permitted by applicable laws and regulations, the Company will not provide personal information to any third party. Where personal information is provided to a contractor within the scope of a previously specified purpose of use, the Company will limit the personal information provided to the extent necessary, require the contractor by contract or other means to appropriately manage the personal information, and provide appropriate guidance and supervision.

Article 5. Joint Use with Group Companies

The Company may jointly use personal data held by the Company as described below for the purposes of business operations in cooperation with its group companies, the provision of products and services, customer support, human resources management, compliance, internal audits, and information security management.

Article 6. Provision of Personal Data to Business Operators Located Outside Japan

To the extent necessary to achieve the purposes of use stated above, the Company may provide personal data to Kiteworks group companies located outside Japan, cloud service providers, and other contractors or joint users located outside Japan.

In such cases, in accordance with the Act on the Protection of Personal Information and other applicable laws and regulations, the Company will enter into agreements with the recipients or take other appropriate measures and will exercise necessary and appropriate supervision to ensure that appropriate security control measures for personal information are continuously implemented by the recipients.

When requested by an individual in accordance with applicable laws and regulations, the Company will provide information concerning the personal information protection system of the relevant foreign country and the personal information protection measures implemented by the recipient.

Article 7. Handling of Employee Information

The Company may share employees’ personal information with Kiteworks group companies for human resources management, labor management, employee benefits administration, IT account management, information security management, compliance, internal audits, and group business management.

The personal information shared will be limited to the extent necessary for business purposes and, except where otherwise permitted by applicable laws and regulations, will not be used beyond the scope of the stated purposes of use.

Individual Numbers under Japan’s Social Security and Tax Number System and other information that requires special handling under applicable laws and regulations will be strictly managed in accordance with the relevant laws, regulations, and the Company’s internal rules.

Article 8. Response to Complaints, Consultations, and Requests for Disclosure

The Company will respond promptly and within a reasonable scope to complaints and consultations concerning the handling of personal information and to requests from individuals for access to, correction of, or other action concerning their own personal information.

Article 9. Handling of Personal Information in Outsourced Operations

Where the Company is entrusted with operations involving the handling of personal information, the Company will strictly manage the personal information entrusted to it and use such information only for the purposes of the entrusted operations. Except where otherwise permitted by applicable laws and regulations, the Company will not entrust the handling of, or provide, such personal information to any third party without the consent of the party that entrusted the operations to the Company.

The Company will not disclose or provide customers’ personal information to any third party except where the consent of the individual has been obtained or where such disclosure or provision is required or permitted by applicable laws and regulations.

Where the Company jointly uses personal data with group companies or provides personal data to a business operator located outside Japan, such personal data will be handled in accordance with Section 5, “Joint Use with Group Companies,” and Section 6, “Provision of Personal Data to Business Operators Located Outside Japan,” below.

5. Joint Use with Group Companies

The Company may jointly use personal data held by the Company as described below for the purposes of business operations in cooperation with its group companies, the provision of products and services, customer support, human resources management, compliance, internal audits, and information security management.

6. Provision of Personal Data to Business Operators Located Outside Japan

7. Outsourcing the Management of Personal Information

The Company may outsource the management of personal information where necessary for its business operations. In such cases, the Company will select contractors that are recognized as appropriately handling personal information and will require them, by contract or other means, to appropriately manage the personal information, maintain its confidentiality, and implement other measures necessary to prevent the leakage of personal information. The Company will also ensure that the contractors appropriately manage the personal information.

8. Voluntary Provision of Personal Information

The provision of personal information is voluntary. Please note, however, that if the required information is not provided, the Company may be unable to provide an appropriate response or take appropriate action.

9. Requests for Disclosure and Other Actions Concerning Personal Information

The Company accepts requests for notification of the purposes of use of personal information; disclosure; correction, addition, or deletion of personal information; suspension of use; erasure; and suspension of provision to third parties. These actions are collectively referred to as “disclosure and other actions.”

10. Personal Information Protection Manager

In accordance with JIS Q 15001, the Company has appointed a Personal Information Protection Manager to ensure the appropriate management of personal information and to maintain and improve its personal information protection framework.
